States transfer industrial relations powers
Several State Parliaments have recently considered legislation to transfer industrial relations powers to the Commonwealth, which will bring private sector workers within coverage of the Federal Fair Work Act. Queensland and South Australia have passed legislation referring industrial powers, as provided for by section 51 (xxxvii) of the Constitution, and similar legislation is currently before the New South Wales and Tasmanian Parliaments. These States will join Victoria, which transferred its industrial powers in 1996.
Once complementary legislation has been enacted by the Commonwealth Parliament, workers in the private sector in the relevant States will be covered by aspects of the Fair Work Act, such as unfair dismissal standards, redundancy provisions and rights to request flexible working arrangements, which may not have applied under State laws. From 2010 the ten national employment standards will also apply.
To now, Federal legislation covered Commonwealth employees, all workplaces in the Territories and most workplaces in Victoria. As corporations are the only business structures specifically covered by the Constitution, private sector businesses such as sole traders and partnerships have so far been excluded from Commonwealth coverage. Once the most recent transfer of powers is completed, all workplaces other than state and local government authorities, and excluding Western Australia, will be covered by the Fair Work Act. The Western Australian Government has indicated that it will not participate in the national industrial relations scheme.
For the library and information sector, the main workplaces affected by the transfers of powers will be smaller libraries, such as law libraries, where staff have been employed by partnerships and unincorporated businesses, which were covered by state industrial laws.
