Fair Work Act
The Federal Government's Fair Work Act has now become law and most of its provisions came into force from 1 July, with remaining sections applying from January 2010.   The main features of the new legislation include increased protection from unfair dismissal, ten minimum employment conditions, widened provisions for unpaid parental leave and rights to request flexible working arrangements to cover parental responsibilities.

Administrative structures of the Australian workplace relations system will also change in coming months.  Fair Work Australia will be fully operational by 1 January 2010 and will replace the Australian Industrial Relations Commission, Australian Fair Pay Commission, Workplace Authority, Workplace Ombudsman and Australian Building and Construction Commission (from 1 February).  The Fair Pay Commission will remain in its current form until 31 July 2009 to enable the current wage review to be completed: see www.fairpay.gov.au/fairpay/WageReviews

Collective Agreements
Many Collective Agreements (also known as Enterprise Agreements) may have expired on 30 June 2009.  Where a new agreement is not in place, or is waiting for approval by the Workplace Authority or relevant State body, the terms of the expired agreement will continue to cover a workplace until a new agreement is in place.   Information relating to negotiation and approval processes is at www.workplace.gov.au, clicking on 'Agreements'.
